Client Working Terms & Conditions

1. Scope of Work

• All projects will be confirmed in writing before work begins.
• The scope will include the agreed deliverables, timescales, and costs.
• Any additional work outside the agreed scope (“out-of-scope work”) will be quoted separately before it is undertaken.

2. Communication & Response Times

• Communication is primarily via email for clarity and record-keeping.
• WhatsApp, text messages, and other informal messaging services are not acceptable for discussing project points, deliverables, or approvals. This ensures consistency and a clear, auditable record of all decisions.
• Calls and meetings can be arranged where needed and may be chargeable if outside agreed project time.
• We aim to respond to all client communications within 24 hours during business hours.

3. Client Responsibilities

To help your project run smoothly, clients agree to:

• Provide all necessary content (text, images, product details, etc.) in a timely manner.
• Respond promptly to emails, proofs, and feedback requests.
• Ensure any materials provided do not infringe copyright or third-party rights.

4. Revisions & Approvals

• All projects include a set number of revisions, agreed at the start.
• Additional revisions may be charged at the standard hourly rate.
• Once a design or project stage is approved, further changes may be treated as additional work.

5. Payment Terms

• A non-refundable deposit (typically 50%) is required before work begins, unless otherwise agreed.
• The remaining balance is due on the day the website goes live, as this marks the official completion of the project.
• Payment terms are otherwise strictly 14 days from invoice date unless otherwise stated.
• Late payments may incur a fee in line with UK Late Payment legislation.

6. Intellectual Property

• All original design and development work created by apluskdesign remains the property of apluskdesign until full payment has been received.
• Once paid in full, ownership of the final deliverables is transferred to the client.
• apluskdesign reserves the right to showcase completed projects in portfolios, case studies, and promotional material unless otherwise agreed.

7. Confidentiality

• Both parties agree to treat any confidential information shared during a project as strictly confidential.
• apluskdesign will not disclose sensitive client information to third parties without prior consent.

8. Support & Maintenance

• Unless included in your project or hosting package, ongoing support, content updates, and maintenance are chargeable separately.
• Support requests outside of project scope will be quoted before work begins.

9. Further Developments & Ongoing Growth

• Many websites — particularly eCommerce projects or content-rich sites — are designed to grow and evolve over time. This may include adding new products, features, integrations, or expanding content on a continuous basis.
• Further developments are not included within the scope of the initial project agreement unless specifically stated. Any additional work will be discussed, scoped, and quoted separately before it begins.
• apluskdesign is committed to supporting your website as it develops, ensuring that growth is managed strategically and delivered to a high standard.
• We see your website not as a “finished product” but as the start of a working relationship. Our goal is to help your business grow and succeed online, not only by maintaining the technical side but also by advising on best practices, opportunities, and long-term improvements.
• For new websites or businesses starting from scratch, apluskdesign can provide ongoing mentoring and guidance — from managing your site confidently to understanding digital tools, SEO, and content strategy. This tailored support helps you build confidence in running your online presence.

10. Cancellation & Termination

• Either party may cancel a project in writing.
• Deposits are non-refundable.
• If cancellation occurs after significant work has been completed, a proportional fee may be charged for time and resources used.
• apluskdesign may terminate the agreement if a client fails to communicate, provide materials, or pay invoices.

11. Liability

• While every effort is made to deliver high-quality work, apluskdesign cannot be held liable for:
  • Losses, damages, or issues caused by third-party services or software.
  • Errors or omissions in client-provided content.
  • Business losses, loss of data, or consequential damages arising from the use of our services.
• Our liability is limited to the fees paid for the project in question.

12. Governing Law

• These Terms & Conditions are governed by UK law.
• Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
