Journey Analytics Terms of Use

Version: JA-TERMS-1.0
Effective date: [DATE]
Provided by: apluskdesign

Business address: [BUSINESS ADDRESS]

These Terms explain how Journey Analytics may be used and the responsibilities that apply when you use it.

They are written for business and professional users and are intended to be clear and easy to understand.

By accepting these Terms, you confirm that you are authorised to accept them on behalf of the organisation that uses Journey Analytics.

1. What Journey Analytics is

Journey Analytics is website performance and business intelligence software.

It helps you understand how people find and use your website, the journeys they take, what leads towards meaningful outcomes and what you may want to do next.

Depending on your licence, setup and available features, Journey Analytics may include tools such as:

  • Visitor Journeys
  • Goals
  • Business Events
  • Significant Events
  • Performance Story
  • Search Intelligence
  • website performance reporting
  • recommendations
  • integrations with other services
  • future connected services, applications or intelligence tools

Journey Analytics is designed to make website evidence easier to understand.

It does not replace your own judgement or professional advice where that is needed.

2. How Journey Analytics interprets information

Journey Analytics works with four levels of information:

KNOWN
Information that has been directly provided, configured or confirmed.

OBSERVED
Information recorded from website activity or connected services.

INFERRED
A relationship, pattern or explanation suggested by the available evidence.

RECOMMENDED
A suggested action or area you may wish to investigate.

These levels are important.

An inference or recommendation is not automatically a fact.

Journey Analytics may identify patterns, relationships, unusual activity or possible opportunities, but it will not always be possible to prove why something happened.

Where the evidence does not support certainty, Journey Analytics should not be treated as providing certainty.

3. Correlation does not always mean causation

Two things happening at around the same time does not necessarily mean that one caused the other.

For example, Journey Analytics may show that website traffic increased after a newsletter, advert, social media post or business event.

That may be useful evidence, but it does not automatically prove that the activity caused every visit, enquiry or sale that followed.

Journey Analytics may highlight possible relationships where the evidence supports doing so, but you remain responsible for deciding how much weight to give that information.

4. Visitor journeys and device limitations

Journey Analytics records journeys using the technical evidence available to it.

A visitor journey may be specific to a particular:

  • device
  • browser
  • session
  • website
  • technical identifier

Journey Analytics may not always be able to recognise that activity on different devices or browsers belongs to the same person.

For example, a person visiting first on their phone and later on their laptop may appear as two separate journeys.

Unless Journey Analytics has sufficient lawful and reliable evidence to connect activity across devices or environments, separate activity must not be assumed to belong to the same individual.

Journey Analytics does not promise to identify a person across every device, browser or visit.

5. Attribution and evidence limitations

Website analytics are never completely perfect.

Journey Analytics may sometimes have incomplete, delayed or unavailable information because of factors outside its control.

These may include:

  • browser privacy settings
  • blocked scripts or storage
  • deleted cookies or local browser data
  • visitors changing devices or browsers
  • missing referral information
  • search engines withholding information
  • third-party services being unavailable
  • integrations being disconnected
  • technical errors
  • hosting issues
  • database problems
  • security tools
  • caching
  • visitors leaving before an event can be recorded
  • bots or automated traffic
  • configuration choices
  • excluded content or users

Journey Analytics may provide the best interpretation supported by the available evidence, but attribution may sometimes be incomplete, approximate or unavailable.

6. No guaranteed results

Journey Analytics helps you understand website performance.

It does not guarantee any particular business result.

We do not guarantee that using Journey Analytics will increase:

  • website traffic
  • search rankings
  • impressions
  • clicks
  • enquiries
  • leads
  • bookings
  • sales
  • revenue
  • conversion rates
  • advertising performance
  • customer retention
  • business growth

A recommendation from Journey Analytics does not guarantee that following it will produce a particular result.

Business performance depends on many factors outside Journey Analytics.

7. Your responsibility

You remain responsible for the decisions you make using Journey Analytics.

This includes responsibility for:

  • how Journey Analytics is configured
  • how Goals are defined
  • how Business Events are recorded
  • how reports and recommendations are interpreted
  • deciding whether to act on a recommendation
  • checking important conclusions where necessary
  • ensuring your website complies with relevant legal and privacy requirements
  • maintaining appropriate website and database backups
  • keeping connected services and access credentials secure

Journey Analytics is intended to support your decisions, not make them for you.

8. Your licence to use Journey Analytics

Journey Analytics is licensed, not sold.

Unless your licence states otherwise, the standard Journey Analytics licence is a Single-Installation Licence.

A Single-Installation Licence allows Journey Analytics to be activated and used on one authorised production website installation at a time.

Your licence may also define things such as:

  • the website or installation it applies to
  • the features available to you
  • the licence period
  • access to updates
  • access to support
  • access to premium features
  • access to hosted or connected services

A licence may be transferred or reassigned where permitted by apluskdesign, for example when a website is migrated, replaced or moved to a new installation.

Journey Analytics may offer other licence types in the future, including licences designed for:

  • developers
  • agencies
  • multiple websites
  • specialist or enterprise use
  • other authorised arrangements

The rights and limits of those licences will be defined by the relevant licence or service entitlement.

You must not knowingly:

  • use a Single-Installation Licence on more than one production installation at the same time
  • redistribute Journey Analytics without permission
  • resell it unless authorised to do so
  • remove ownership or copyright notices
  • bypass licence or entitlement controls
  • use another customer’s licence or credentials
  • interfere with protected Journey Analytics services
  • represent Journey Analytics as software owned or created by another party

If you need help with your licence, want to transfer an existing licence, or would like to ask about a different licence type, please contact:

journeyanalytics@apluskdesign.com

9. Ownership and intellectual property

Journey Analytics, its software, branding, interface, documentation and related proprietary systems belong to apluskdesign or its licensors.

Using Journey Analytics does not transfer ownership of the software to you.

At the same time, a Journey Analytics licence does not transfer ownership of your website or your first-party analytics history to apluskdesign.

Your website data remains your data, subject to the way Journey Analytics is technically designed to store and process it.

10. Your analytics history

We believe your first-party website evidence should not be held hostage because a licence ends.

If a paid licence expires, is cancelled or is removed, some licensed features, services, updates or integrations may stop being available.

Journey Analytics may move to a more limited or Free capability level where one is available.

However, we will not intentionally use licence expiry as a reason to destroy your existing first-party analytics history.

This does not prevent data from being removed because of:

  • your own deletion choices
  • retention settings
  • plugin removal
  • database loss
  • backups being restored
  • technical failure
  • legal requirements
  • normal data-management processes

11. Free, beta and licensed versions

Journey Analytics may offer different capability levels.

These may include:

  • beta versions
  • Free versions
  • licensed versions
  • complimentary licences
  • early-adopter licences
  • evaluation licences
  • specialist add-ons
  • hosted services

Different versions may include different features.

Your current licence or entitlement determines what you are authorised to use.

The existence of a feature in one version does not mean that it will be included in every version.

12. Beta software

Some Journey Analytics versions may be supplied as beta or evaluation software.

Beta software is provided for testing, learning and feedback.

It may:

  • contain bugs
  • change during development
  • include experimental features
  • behave differently from the final commercial release
  • lose or replace functionality before full release

A beta licence does not automatically become a commercial production licence unless we confirm that it does.

You should not rely on beta software as the only copy of important business information.

13. Updates and changes to Journey Analytics

Journey Analytics will continue to develop.

We may add, change, replace or remove features where necessary.

This may be because of:

  • product improvements
  • security
  • technical compatibility
  • changes to WordPress
  • changes to third-party services
  • legal requirements
  • performance
  • reliability
  • commercial decisions

We will aim to avoid unnecessary disruption.

We will not intentionally use a software update or licence change to destroy your existing first-party analytics history.

14. Third-party services

Journey Analytics may connect to or use services provided by other organisations.

Examples may include search services, WordPress services, APIs, hosting providers, AI services or other integrations.

Those services operate under their own terms and policies.

We do not control their availability, accuracy or continued operation.

A third-party service may:

  • change its API
  • change its terms
  • restrict access
  • delay information
  • provide incomplete information
  • experience outages
  • stop providing a service

Journey Analytics cannot guarantee the continued availability of third-party integrations.

15. Future hosted services, applications and AI features

Journey Analytics may in future connect to additional apluskdesign services, including hosted services, artificial intelligence tools, the Journey Analytics Companion App or other connected products.

These services may have additional terms, privacy information or service conditions.

Any future intelligence or AI service remains subject to the same evidence principles described in these Terms.

AI-generated or automated output must not automatically be treated as fact.

KNOWN remains known.

OBSERVED remains observed.

INFERRED remains inferred.

RECOMMENDED remains recommended.

16. Privacy and data protection

These Terms are not a privacy notice.

Journey Analytics may have separate privacy, data protection, cookie or data-processing documentation explaining how information is collected, stored or processed.

You remain responsible for making sure that your own website provides any privacy information, cookie controls or other notices required for your use of Journey Analytics.

Where apluskdesign acts as a data processor for a hosted service, additional data-processing terms may apply.

Questions about Journey Analytics privacy or data handling can be sent to:

journeyanalytics@apluskdesign.com

17. Acceptable use

You must not use Journey Analytics:

  • for unlawful purposes
  • to deliberately harm another person or system
  • to attack or interfere with another website
  • to bypass security measures
  • to misuse connected services or APIs
  • to gain access you are not authorised to have
  • to deliberately avoid licence controls
  • to overload or abuse hosted Journey Analytics infrastructure

We may restrict or suspend access to hosted services where reasonably necessary to protect security, users or the service itself.

18. Availability and support

We aim to make Journey Analytics reliable, clear and easy to use, but we cannot guarantee that it will always be available or completely error-free.

Journey Analytics depends on systems that may be outside our control, including:

  • WordPress
  • your hosting provider
  • your database
  • your browser
  • other plugins and themes
  • connected services
  • network availability

Getting support

If you need help with Journey Analytics, please contact:

journeyanalytics@apluskdesign.com

You can use this address for:

  • help using Journey Analytics
  • questions about features or configuration
  • reporting a possible problem or bug
  • licence questions
  • licence transfers
  • questions about different licence types
  • feedback or suggestions
  • questions about updates or compatibility

The level of support available to you may depend on your licence or service entitlement.

Unless we have agreed otherwise, Journey Analytics support does not include a guaranteed response time or service-level agreement.

We will always aim to deal with support requests reasonably and appropriately.

What standard Journey Analytics support does not automatically include

Unless separately agreed, Journey Analytics support does not include:

  • general WordPress support
  • website design or development work
  • hosting administration
  • fixing unrelated third-party plugins or themes
  • work caused by problems with external services
  • bespoke Journey Analytics development
  • custom integrations
  • marketing, SEO, legal, financial or other professional consultancy

We may still be able to help with these areas, but they may require a separate agreement or service.

Where a problem appears to involve Journey Analytics interacting with another plugin, theme, service or environment, we may ask for reasonable information to help us investigate it.

Product updates and known issues

Where appropriate, Journey Analytics may provide information about known compatibility issues, resolved problems, important updates or actions users should take.

Some technical information may also be available within Journey Analytics Developer Tools.

Support information and product contact details may change over time. The current Journey Analytics support address will be made available within the product where practical.

19. Backups

You are responsible for maintaining appropriate backups of your website and database unless a separate agreement says otherwise.

Journey Analytics should not be treated as a replacement for a proper website backup system.

20. Suspension and termination

We may suspend or terminate access to licensed or hosted services where there is:

  • serious misuse
  • security risk
  • unlawful activity
  • deliberate licence abuse
  • material breach of these Terms
  • non-payment where payment is required
  • another serious reason that makes continued service unreasonable

Where practical, we will aim to deal with issues proportionately.

Ending a licence or service does not give us the right to claim ownership of your first-party analytics history.

21. Liability

Journey Analytics is designed to support better understanding and decision-making.

However, business decisions remain yours.

To the fullest extent permitted by law, apluskdesign will not be responsible for losses that arise solely because you relied on incomplete, unavailable, inferred or recommended analytics information without applying reasonable business judgement.

We are also not responsible for failures caused by third-party services, hosting providers, WordPress, other plugins, browsers, devices or systems outside our reasonable control.

Nothing in these Terms limits any liability that cannot legally be limited or excluded.

[FINAL COMMERCIAL LIABILITY CAP TO BE CONFIRMED AFTER LEGAL REVIEW.]

22. Changes to these Terms

We may update these Terms from time to time.

Each version will have its own version number or document identifier.

Some changes may simply clarify wording or explain the product more clearly.

Those changes may not require you to accept the Terms again.

If we make a material change that affects your rights, responsibilities or the way Journey Analytics is provided, we may require an authorised user to accept the updated Terms before continuing to use the Journey Analytics administration interface.

Your website tracking and existing analytics history should not be deliberately stopped or deleted simply because re-acceptance is pending.

23. Accepting these Terms

Journey Analytics may require an authorised WordPress user to confirm acceptance of the current Terms.

The acceptance record may include:

  • acceptance status
  • accepting WordPress user
  • date and time accepted
  • Terms version
  • document identifier
  • website or installation identity

Journey Analytics is the authoritative source of the acceptance record.

Connected estate-management services such as Geneva may receive only the minimum status needed to show whether the current Terms have been accepted.

This may include:

  • Accepted
  • Re-acceptance required
  • Not accepted
  • accepted date and time
  • Terms version

Geneva does not need visitor-level Journey Analytics evidence or unnecessary personal information in order to record Terms acceptance status.

Acceptance confirms that the authorised user agreed to the Terms presented to them.

It does not claim or attempt to prove that the user read every individual sentence.

24. Governing law

These Terms are governed by the laws of England and Wales.

Any dispute relating to these Terms will be subject to the courts of England and Wales, unless applicable law requires otherwise.
